Terms of Service

These terms cover the Tracker macOS app and this website, usetracker.app. Using either means you accept them.

They are short on purpose. Tracker holds none of your data on a server, so most of what a long agreement usually has to cover simply does not apply here.

Early access

Tracker is early-access software and is still being built. Features can change or disappear between builds, and an early build can have bugs. Keep your own backups of anything you would be unhappy to lose.

Joining the waitlist is not a purchase. It puts your email address on a list so we can tell you when the app ships. It is not a promise of a release date, of a particular feature, or of continued access to early builds.

Price and license

Free during early access. One-time license after launch. There is no subscription: the app runs on your own Mac, so there is nothing to rent.

A license, once one exists, is granted to you personally. It is a non-exclusive, non-transferable right to install and use Tracker on Macs you own or control, for your own work, including commercial freelance work. You may not resell, sublicense, rent, lend or transfer it to someone else.

Prices and the exact terms of the move from early access to a paid license will be published before launch. Nothing on this page is a commitment to a particular price.

Your data and your exports

Your tracking data is yours. It lives in a SQLite file on your Mac and we never receive it, so there is nothing here for us to claim rights over. Exports are equally yours: use them commercially, send them to clients, and keep them long after you stop using Tracker.

We claim no license over your data, your exports, or anything you produce with the app. How this works in practice is described in theprivacy policy.

What you may not do

• Reverse engineer, decompile or disassemble the app, except where that right cannot legally be waived.
• Redistribute, resell, repackage or host the app or its installer.
• Remove or alter license and copyright notices.
• Use the app to break the law, or to monitor another person without their knowledge and consent. Tracker is a tool for tracking your own work.

No warranty

Tracker is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

In particular, we do not warrant that the app runs without interruption or error, or that the hours it records are complete or accurate enough for any given invoice, contract or legal purpose. Check your hours before you bill them.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, nor for lost profits, lost revenue, unbilled time, or lost or corrupted data arising from your use of Tracker or of this site.

Where liability cannot be excluded, it is limited to what you paid for Tracker in the twelve months before the claim — which, during early access, is nothing. Some jurisdictions do not allow these exclusions; where that is the case, they apply only as far as the law permits.

Ending this agreement

You can stop at any time: quit the app, delete it, and delete the database file. That ends everything, because there is no account to close and no stored copy to reclaim.

We can suspend or end access to early-access builds, and to the waitlist, if these terms are broken or if the early-access programme ends. A license you have paid for is not revoked because the programme ends.

Governing law

These terms are governed by the laws of the Argentine Republic. Any mandatory consumer protection rights you have where you live are not affected by that.

Changes to these terms

These terms change as the product does. The date at the top of the page moves with them, and a material change is announced to the early-access list. Continuing to use Tracker after a change means you accept the updated version.
